A. Background/Options
The applicant is requesting approval of a Conditional Use Permit to develop a 4-story, multi-unit residential development on a 3.67 acre property at the northwest corner of N. Mayfair Road and W. Wisconsin Avenue in the Special Purpose - Research Park and Mayfair Overlay (SP-RP/MAY) District. The project site currently serves as a parking area for the Irgens Research Park development.
The project contains 196 residential units with both surface and below-grade parking (275 parking spaces total) as well as long and short-term bike parking. Residential units consist of studio, one-bedroom, and two-bedroom units. Access to the site is proposed from Wisconsin Avenue. An access point is also provided at the north end of the site but is controlled with a gate. Project amenities include courtyard with pool and dog run, club room and kitchen, fitness center, pet spa, and electric vehicle chargers.
In November 2023, the City granted approval of a 4-story multi-unit residential development containing 201 units on the project site. Ultimately, the applicant decided to sell the property and not pursue the development.

B. Staff Comments
Planning/Zoning Division
The project site is located within the Wauwatosa Life Sciences District Master Plan that encourages high-density residential development.
Twenty-five (25) public notification letters related to the project were sent per City regulations.
Building Division
Applicable building permits required.
City Assessor’s Office
Provide detailed costs of any alterations and/or new construction as well as income and expense information as requested by the Assessor’s office.

Engineering Division
Site plans showing adequate sewer capacity, construction staging information, lighting, and storm water management subject to approval by the Engineering Division.
Engineering is receptive to reviewing/commenting on proposals for traffic calming and on-street parking along Wisconsin Avenue as part of the development review and approval process.
The gate entry/exit at the north side of the property will need to require secure access for vehicles entering the site and for vehicles leaving the site.
Fire Department Connections, hydrant locations, and emergency access are subject to approval by the Fire Department.
Hydrant testing and water supply demand calculations for the proposed development's domestic and fire suppression needs will be required.
Easements will be required for the proposed cross access to the north and any retaining walls and/or utilities that are not wholly located on the subject property.
The City has obtained a State grant for the 2026 construction of a multi-use trail that will connect the Regional Medical Campus to this development. The applicant shall continue to support efforts for this multi-use trail connection and work with staff on the required multi-use trail easement and construction coordination.
Applicant shall meet all requirements of code chapter 24.12 pertaining to landscaping; including the requirement for a landscape performance guarantee (Section 24.12.070).
Fire Department
Vehicular access from both Wisconsin Avenue and the north end of the site were requested from the Fire Department and have been identified on the plans. The Fire Department is supportive of multiple access points to the site as it would support the department’s ongoing efforts to improve response times to critical incidents.
All applicable fire code must be adhered to. The Fire Department would need to approve the access to the north side of the building (plans state a gate). Emergency vehicle access needs to be approved by Fire Department.

C. Recommendation
Staff recommends approval subject to:
1. Providing detailed costs of any alterations and/or new construction, as well as income and
expense as requested by the Assessor's office.
2. Approval of site plans showing adequate sewer capacity, construction staging information, lighting, and storm water management subject to approval by the Engineering Division.
3. Fire Department connections, hydrant locations, and emergency access are subject to approval by the Fire Department.
4. Hydrant testing and water supply demand calculations for the proposed development's domestic and fire suppression needs are required.
5. Short- and long-term bicycle parking must be clearly identified and quantified to confirm compliance with City Code 24.11.080.
6. The applicant shall continue to support efforts for the multi-use trail connection and work with staff on the required multi-use trail easement.
7. Applicant shall meet all requirements of code chapter 24.12 pertaining to landscaping; including the requirement for a landscape performance guarantee (Section 24.12.070).
8. Under WMC 24.16.040I., a Conditional Use will lapse and have no further effect one year after it is approved by the Common Council, unless a building permit has been issued (if required); the use or structure has been lawfully established; or unless a different lapse of approval period or point of expiration has been expressly established by the Common Council.
