A. Background/Options
In November 2018, the City approved a Conditional Use Permit to allow a church (Victorious Living Christian Center) at 10101 W. Capital Drive in the General Commercial (C2) zone. The applicant is now requesting to modify the Conditional Use Permit to allow a before and after school child care program in addition to the church. The child care program will be run by the church and will operate Monday through Friday, from 6:00 am to 9:00 am and 3:00 pm to 6:00 pm during the school year (August - June). The church will provide care for no more than 50 children ages 5-12 years old. Child care activities will occur within the confines of the existing church space and no outdoor play area is proposed. The State of Wisconsin does not require an outdoor play area for before and after school child care facilities.

B. Staff comments
Planning/Zoning Division: A sufficient amount of parking exists onsite for the proposed use and other businesses onsite. Adequate pick up and drop off facilities are located at the east end of the building within the parking area adjacent to the building entrance.
Building Division: Plan review & applicable building permits including occupancy permit is required. DSPS plan approvals may be required depending on scope of work.
Assessor's Office: Provide detailed costs of any alterations and/or new construction, as well as income & expense information as requested by the Assessor's Office.
City Clerk’s Office: No issues.
Engineering Division: A pick-up and drop off parking lot circulation plan must be submitted for review. Additional parking lot striping may be required to facilitate safe ingress and egress at the site.
The existing dumpster in the south parking lot must meet City Code 24.12.040 screening requirements.
Any building project in excess of $100,000 is subject to sanitary sewer lateral replacement or repair if the existing lateral does not pass Board of Public Works testing requirements according to City Code 13.30.030.
Fire Department: No issues at this time. All fire codes must be adhered to.
Health Department: No comments provided.
Police Department: No comments provided.
C. Recommendation
Staff recommends approval subject to:
1. Establishing hours of operation.
2. Providing detailed costs of any alterations and/or new construction as well as income and expense as requested by the Assessor’s Office.
3. Submitting a pick-up and drop off parking lot circulation plan for Engineering review and approval prior to issuing occupancy permit. Additional parking lot striping may be required to facilitate safe ingress and egress at the site.
4. Screening the existing dumpster in the south parking lot per City Code 24.12.040 prior to occupancy permit issuance.
5. Any building project in excess of $100,000 is subject to sanitary sewer lateral replacement or repair if the existing lateral does not pass Board of Public Works testing requirements according to City Code 13.30.030.
6. Under 24.16.040I., a Conditional Use will lapse and have no further effect one year after it is approved by the Common Council, unless a building permit has been issued (if required); the use or structure has been lawfully established; or unless a different lapse of approval period or point of expiration has been expressly established by the Common Council
7. Obtaining any additional permits, licenses, and approvals.
