A. Issue
According to City Code 15.02.100, no person, firm or corporation shall at any time between the hours of seven p.m. and seven a.m. Monday through Saturday, or during any hours on Sunday create any loud or sharp noises, concussions, or disturbing sounds associated with the construction, excavation, demolition, alteration, or repair of any building or development. The board of public works may modify these times upon request for variance and based on exceptional circumstances.
We Energies is requesting overnight and Sunday permission to work until the conclusion of the work pertaining to the Harlow + Hem project.
B. Background/Options
The applicant has provided the purpose of request noted below:
Due to adverse impacts to the surrounding customers who are open for business from Monday-Saturday, We Energies is requesting to work on Sundays and nights going forward in order to minimize impact to the businesses during ordinary hours. Nighttime hours and Sundays provide additional safety to the crews during hours with minimal traffic and provide a time frame by which the bank and some other businesses are not operating. While the extended hours working schedule will be sporadic, it will not occur regularly overnight or on every Sunday. Due to the provisions in the permit, We Energies is in need of additional flexibility to complete this project as soon as they are able to.
All work is anticipated to be complete by mid-April.

E. Recommendation
Staff recommends that the Board of Public Works grant We-Energies an extension of work hours to include overnight and Sundays subject to the following conditions:
• The applicant continuing the coordinate and communicate with local Alderpersons, City Engineering, the Village BID, and location businesses regarding updates to the schedule.
• At least 5 days notice must be provided to the local Alderpersons, City Engineering, and the Village BID when overnight work and work on Sundays will occur.
