A.                     Issue

Authorize staff to execute an intergovernmental cooperation agreement (ICA) with the Milwaukee Metropolitan Sewerage Distract (MMSD) for the Menomonee River Levee System Accreditation projects.

 

 

B.                     Background/Options 

Over the last 20 years, MMSD has been implementing flood control projects along the Menomonee River focused on flood risk reduction.  Included in these projects is a levee and flood wall system that was constructed in 2006 from approximately N. 74th Street to N. 60th St within the City of Wauwatosa. 

 

FEMA manages the National Flood Insurance Program (NFIP), which provides the maps and regulatory basis for the City’s floodplain management. The NFIP is managed by the City through our floodplain management ordinance.

 

FEMA accreditation of the Levee System constitutes official recognition of the flood risk reduction that the District’s projects are anticipated to achieve and results in updated floodplain maps.

 

To attain FEMA accreditation, however, the Levee System must comply with 44 C.F.R. § 65.10, requiring improvements to the previously constructed earthen levee and floodwall freeboard, backflow closure and outfall extension storm sewer improvements, and sanitary and storm sewer rehabilitation and replacement near the Levee System (the Levee System improvements outlined in this Agreement collectively constitute the Project). The Project is anticipated to be implemented through multiple City and District capital projects and contracts.

 

Even after FEMA levee accreditation, residual flood risk remains.                     Additionally, to preserve levee accreditation for the lifespan of the infrastructure, the District and the City must cooperate closely to maintain compliance with the federal requirements.

D.                     Fiscal Impact

The agreement outlines the cost responsibilities for design, construction and long term maintenance between the City and the District.  Initially, the only cost to the City will be for the 2” asphalt paving of the maintenance drive for a multi-use trail.  This cost has been planned for within CIP proj. 8019, Improvements at Hart Park, East of 68th
