A. Background/Options
The applicant is proposing to operate a 1,250 square foot eating & drinking establishment (bake shop) in an existing commercial building located at 8932 W. North Avenue in the Midtown Mixed-Use (MID-MIX) District. Surrounding land uses are multi-family residential to the north and west and commercial to the east and south. The floor plan contains a seating and display area, production room, retail area, office, and restroom. No outdoor dining is requested. The entrance into the building is located at the south end of the building adjacent to the onsite parking area. The proposed operating days and hours of operation are Tuesday through Saturday, from 10:00 am to 6:00 pm.

B. Staff Comments
Planning/Zoning Division
Ten parking spaces are provided onsite, which is the amount required by code. However, the project is required to provide one handicap parking space which may reduce parking down to 9 spaces. Staff has no concern with the reduction since street parking is available and accessible parking is required. The applicant will also be providing the required bicycle parking in compliance with WMC 24.11.080.
Screening of any trash containers is required per WMC 24.12.040.A.3.
Building Division
Design Review Board approval required. Plan review & applicable building permits including occupancy permit is required. DSPS plan approvals may be required depending on scope of work.
City Assessor’s Office
Provide detailed costs of any alterations and/or new construction, as well as income & expense information as requested by the Assessor's Office.
City Clerk’s Office
If they intend on selling tobacco products, they will need a license. Otherwise no issues.
Engineering Division
A van accessible handicap parking space in compliance with ADA regulations must be incorporated into the site plan. A revised parking lot plan showing the location of the additional handicap parking stall must be submitted and approved by Engineering.
Any building project in excess of $100,000 is subject to sanitary sewer lateral replacement or repair if the existing lateral does not pass Board of Public Works testing requirements according to City Code 13.30.030.
City records show that this building is served by an existing 1 inch lead water lateral from the building to the curb stop. Staff strongly recommends that this lead piping is replaced.
Fire Department
No issues. All applicable fire codes must be followed.
Health Department

C. Recommendation
Staff recommends approvals subject to:
1. Establishing hours of operation.
2. Providing detailed costs of any alterations and/or new construction, as well as income & expense as requested by the Assessor's office.
3. Providing short- and long-term bicycle parking in compliance with City Code 24.11.080 prior to occupancy permit issuance.
4. Prior to occupancy permit issuance, submitting a revised parking lot plan for Engineering approval that provides a van accessible handicap parking space in compliance with ADA regulations and included screening of trash containers.
5. Any building project in excess of $100,000 is subject to sanitary sewer lateral replacement or repair if the existing lateral does not pass Board of Public Works testing requirements according to City Code 13.30.030.
6. Under WMC 24.16.040I., a Conditional Use will lapse and have no further effect one year after it is approved by the Common Council, unless a building permit has been issued (if required); the use or structure has been lawfully established; or unless a different lapse of approval period or point of expiration has been expressly established by the Common Council.
