A. Issue
Michael Miller, Roettgers Company, Inc, d/b/a Tosa Mobil, has submitted an application for a new retail class “A” Beer license for their gas station located at 8806 W. North Avenue.
B. Background/Options
Tosa Mobil is looking to obtain a retail Class “A” beer license. A background check was conducted on the Agent, Michael Miller, on June 27, 2024 and no violations substantially related to licensing activities were found.
History on this applicant: An application was made in 2022 and presented to the Government Affairs Committee (GAC). At the time, GAC made a recommendation to deny the application 5-3. The Common Council approved Resolution R-22-136 (attached) denying the application unanimously. The reasons given for denial were the following:
• Wauwatosa has, in the past, traditionally discouraged and denied alcohol license application for sale at establishments which also dispense gasoline, due to the association between gasoline sales and the dangers of alcohol consumption in the context of driving vehicles on public roadways; and \
• The location has a small lot size, and is located at a busy intersection, which would become even more crowded and congested if traffic were to increase due to packaged beer sales at the convenience store; and
• There are multiple sources for the purchase of packaged beer and other liquor products within a very short distance from the location for which sales are requested (approximately 6 other Class “A” or Class “B” licensed establishments within two blocks of the location);

Fire: No issues.
Health: No issues.
D. Recommendation
If unacceptable, recommend the Common Council deny the application for a New Class "A" Beer License by Roettgers Company Inc., Michael Miller - Agent, d/b/a Tosa Mobil, 8806 W. North Avenue, for the period ending June 30, 2025. Specify reasons.
If acceptable, recommend the Common Council grant a New Class "A" Beer License by Roettgers Company Inc., Michael Miller - Agent, d/b/a Tosa Mobil, 8806 W. North Avenue, for the period ending June 30, 2025.
