A. Background/Options
The applicant is proposing an accessory outdoor recreation, participant use as part of an existing drinking establishment (Gathering Place Brewing) at 7208 W. North Avenue in the Neighborhood/Village (C1)/North Avenue Overlay (NOR) District. Outdoor recreation activities will take place within the rear outdoor patio area of the establishment and consists of the following seasonal activities:
Curling: From January to March, the applicant is proposing curling activities within a small ice rink set up under a tent. Time windows of curling activities will be Tuesday - Thursday, from 6:00 pm to 8:30 pm, Friday from 5:00 pm to 8:30 pm, and Saturday from 12:00 pm to 8:00 pm.
Bag Leagues: From May to August, the applicant is proposing to host bag leagues on Thursdays from 6:00 pm to 9:00 pm.
Periodic Special Events: Throughout the year, the applicant is proposing to utilize the patio for temporary outdoor events such as book or record swaps, plant sales, arts and crafts, and other light activities. These special events are proposed to occur within the days and hours of operation for the drinking establishment, which are 4:00 pm to 10:00 pm, Monday through Friday and 2:00 pm to 10:00 pm on Saturday.

B. Staff Comments
Planning/Zoning Division
Planning has no issues with the proposal. In early 2023, curling activities were allowed by the City on a temporary basis. Activities were well managed and the City received no complaints. Conditions have been added to ensure the outdoor patio area will not become a nuisance to the adjacent residential neighborhood. No parking will be removed to accommodate activities.
Twenty-eight (28) public notification letters related to the project were sent per City regulations.
Building Division
Any electrical improvements will require a permit.
City Assessor’s Office
Provide detailed costs of any alterations and/or new construction as well as income and expense information as requested by the Assessor’s office.
City Clerk’s Office
If the area in question is in the public right-of-way, the applicant would need to apply for a Sidewalk Café Permit.
Engineering Division
If a trash dumpster is located outside, it must be screened from view of streets and all abutting lots according to the requirements outlined in City Code 24.12.040.
Fire Department
The patio space would have to follow and adhere to all applicable fire codes.

C. Recommendation
Staff recommends approval subject to:
1. Establishing hours of operation.
2. Providing detailed costs of any alterations and/or new construction as well as income & expense as requested by the Assessor's office.
3. Outdoor patio area shall be kept in a clean, neat, and orderly appearance.
4. If the City receives noise complaints regarding noise regarding outdoor activities, the applicant shall take corrective action to resolve those issues to the satisfaction of the Planning Manager. This may include but not be limited to modifying hours of operation, discontinuance of outdoor activities, and/or other resolution.
5. If a trash dumpster is located outside, it must be screened from view of streets and all abutting lots according to the requirements outlined in City Code 24.12.040.
6. Compliance with applicable fire codes.
