A. Background/Options
The applicant is requesting approval of a Conditional Use Permit to allow secondhand sales of sports and fitness equipment within a 2,100 square foot space at 10111 W. Capitol Drive in the General Commercial (C2) Zone. The proposed operating hours are 10:00 am to 7:00 pm Monday, Tuesday, Wednesday, and Friday; 10:00 am to 5:00 pm Thursday and Saturday; and 11:00 am to 3:00 pm on Sunday. Attached is a floor plan and project description submitted by the applicant.
B. Staff Comments
Planning/Zoning Division
The facility is occupying a space previously occupied by a secondhand sporting goods store (Play it Again Sports). Therefore, no additional vehicular parking is required.
Since the use of the space is not changing, additional short- and long-term bike parking is not required. However, the applicant has indicated they intend to install bike parking at a later date.
Twelve (12) public notification letters related to the project were sent per City regulations.

Final Occupancy inspection and approval required prior to occupancy.
City Assessor’s Office
Provide detailed costs of any alterations and/or new construction as well as income and expense information as requested by the Assessor’s office
City Clerk’s Office
Applicant has already applied for the Second Hand Article Dealer License.

C. Recommendation
Staff recommends approval subject to:
1. Establishing hours of operation.
2. Providing detailed costs of any alterations and/or new construction, as well as income & expense as requested by the Assessor's office.
3. Final Occupancy inspection and approval required prior to occupancy.
4. Under WMC 24.16.040I., a Conditional Use will lapse and have no further effect one year after it is approved by the Common Council, unless a building permit has been issued (if required); the use or structure has been lawfully established; or unless a different lapse of approval period or point of expiration has been expressly established by the Common Council.
