Resolution approving a Conditional Use Permit for a bank drive-through in the General Commercial and Planned Unit Development Overlay (C2/PUD) zone at 7501 W. North Avenue, Luther Group LLC, applicant

WHEREAS Luther Group LLC applied for a Conditional Use Permit for a bank drive-through in the General Commercial and Planned Unit Development Overlay (C2/PUD) zone at 7501 W. North Avenue; and
WHEREAS, the required public hearing was held before the Common Council on June 23, 2026; and
WHEREAS, this request was reviewed and recommended by the City Plan Commission to be necessary for the public convenience at that location; located and proposed to be operated in such manner which will protect the public health, safety, and welfare; and was found to be compatible with surrounding uses;
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Wauwatosa, Wisconsin that it hereby grants a Conditional Use Permit to Luther Group LLC for a bank drive-through at 7501 W. North Avenue, subject to the following conditions:
1. Hours of operation for the bank shall be Monday through Friday from 9:00 a.m. to 5:00 p.m. and Saturday from 9:00 a.m. to 12:00 p.m. The bank ATM at the drive-through may operate 24 hours.
2. Design Review Board approval is required for any exterior changes. Architectural supervision, plan review, and all applicable building permits are required. Final occupancy inspection and approval must be obtained prior to occupancy.
3. Per City Code 13.30.030, any building project in excess of $100,000 shall have the sanitary sewer lateral replaced or inspected and pressure tested per Board of Public Works requirements.
4. The applicant shall provide detailed costs of any alterations and/or new construction, as well as income and expense information, as requested by the Assessor's office.
5. Site plans showing adequate water supply, sewer capacity, storm water management, traffic and access improvements, and construction staging impacts are subject to approval by the Engineering Division. If the overall project will be constructed in two phases, a phasing plan shall be included in the site civil submittal.
6. The applicant shall meet all requirements of City Code Section 24.12 pertaining to landscaping, including the requirement for a landscape performance guarantee under Section 24.12.070. Any proposed exemptions are subject to approval by the Board of Public Works.
7. Prior to occupancy, at the North Avenue and east driveway, the existing easternmost driveway along North Avenue shall be closed and a new east driveway shall be constructed to accommodate right-out-only movements from the bank drive-through.
8. Prior to site plan approval, the applicant shall enter into a Memorandum of Understanding with the City addressing all required mitigation measures for future construction of other uses on the property.
9. The project shall be designed, constructed, and maintained in full compliance with all applicable national, state, and local fire code requirements.
10. Under WMC 24.16.040I, this Conditional Use Permit shall lapse and have no further effect eighteen months after approval by the Common Council unless a building permit has been issued, if required, and the use or structure has been lawfully established, or unless a different lapse period is expressly established by the Common Council.
11. The applicant shall obtain all other required licenses, permits, and approvals.
