A. Background/Options
The applicant is requesting approval of a Conditional Use Permit to operate a 3,100 square foot children’s day care at 7229 W. Center Street in the General Commercial (C2) Zone. Surrounding land uses include residential to the north and south, commercial uses to the east, and a church to the west. The facility will be staffed with 4 employees per shift, and will provide care for up to 50 children with an age range of 4 weeks to 14 years. An outdoor play area is proposed at the south end of the building. Facility operating hours are Monday - Friday, from 6:00 am to 11:59 pm, and Saturday and Sunday from 6:00 am to 6:00 pm.

B. Staff Comments
Planning/Zoning Division
Required parking for the facility is 6 parking spaces and there will be 1 parking space onsite with addition of the playground. To address the parking shortfall:
• Pickup and drop of children can occur utilizing street parking on W. Center Street and Lefeber Avenue.
• Employee parking can occur utilizing onsite parking and street parking west of the site on Center Street and 73rd street.
• Center Street is a Milwaukee County Transit System bus line, with a stop at the southwest corner of Center Street and Lefeber.
• The project has been conditioned to incorporate both short and long-term bike parking per City Code.
To ensure parking does not become an issue, a condition has been added indicating if the City receives parking complaints, the applicant must take corrective action to resolve parking issues to the satisfaction of the Planning Manager and Public Works Director. This may include but not be limited to reducing number of children and/or employees, modifying hours of operation, etc.
Twenty-four (24) public notification letters related to the public hearing and project were sent per City regulations.
Building Division
Architectural supervision, DSPS plan approvals may be required depending on scope of work and applicable building permits required. Final Occupancy inspection and approval required prior to occupancy.
City Assessor’s Office
Provide detailed costs of any alteration and/or new construction, as well as income and expense as requested by the Assessor’s office

Engineering Division
For existing buildings, any building project in excess of $100,000 is subject to sanitary sewer lateral replacement or repair if the existing lateral does not pass Board of Public Works testing requirements according to City Code 13.30.030.
A parking lot/site plan that shows the proposed play area and onsite parking must be submitted to the Engineering Division for review and approval prior to issuing occupancy. A photometric plot for any outdoor lighting that is added must also be submitted to Engineering for review and approval. If a trash dumpster is located outside, it must be screened from view of streets and all abutting lots according to the requirements outlined in City Code 24.12.040.
Employees or customers that utilize street parking must adhere to posted parking regulations. Immediately adjacent to the property, no parking is allowed on the west side of Lefeber Avenue and 2-hour parking from 9 am to 6 pm weekdays is allowed on the east side of Lefeber Avenue. On the south side of W. Center Street, 1-hour parking is allowed from 9 am to 6 pm on weekdays. On-street parking spaces cannot be reserved for a specific business.

All applicable fire codes must be adhered to.

C. Recommendation
Staff recommends approvals subject to:
1. Establishing hours of operation.
2. If the City receives complaints regarding parking, the applicant shall take corrective action to resolve all parking issues to the satisfaction of the Planning Manager and Public Works Director.
3. Providing detailed costs of any alterations and/or new construction, as well as income & expense as requested by the Assessor's office.
4. Short- and long-term bicycle parking must be provided in compliance with City Code prior to issuing Occupancy permit.
5. Submittal of a parking lot/site plan addressing all comments in the Engineering comments section of this report prior to issuing occupancy.
6. Any building project in excess of $100,000 is subject to sanitary sewer lateral replacement or repair if the existing lateral does not pass Board of Public Works testing requirements according to City Code 13.30.030.
7. Under WMC 24.16.040I., a Conditional Use will lapse and have no further effect one year after it is approved by the Common Council, unless a building permit has been issued (if required); the use or structure has been lawfully established; or unless a different lapse of approval period or point of expiration has been expressly established by the Common Council.
8. Obtaining other required licenses, permits, and approvals, including State of Wisconsin group child care center licensing.
