A. Issue
Approval of a Relocation Order and Acquisition Plat in order to acquire a permanent water main easement located at 931-937 North 123rd Street, as part of an eminent domain proceeding, for purposes of necessary water main construction related to the extension of a water main from 123rd Street to 124th Street.
B. Background/Options
In conjunction with the approved agreements to service a portion of Elm Grove with Wauwatosa water, hydraulic studies were completed to determine the necessary level of water infrastructure improvements. As part of that analysis it was determined that connection of two existing dead end water mains is necessary to provide appropriate water service to the new service area as well as benefiting the existing service area near 123rd Street and 124th Street south of Watertown Plank Road. The new water main will be installed between the southern dead end of 123rd Street and the southern dead end of 124th Street. In order to accommodate this extension a 20 foot wide water main easement is needed from a portion of one property, 931-937 North 123rd Street. The easement is located within an area currently used as a driveway and parking for the property owner's tenant's use.
City staff has met with the affected property owner and believed that we had reached agreement for the approval of the easement in exchange for some property improvements the property owner requested. The property owner is now instead requesting a monetary purchase so I am requesting we initiate the formal process to acquire an easement. Through the current agreements between the City, Elm Grove, and the Developer, the cost for this acquisition will not be borne by the City of Wauwatosa.
Attached is a proposed Relocation Order with an attached Acquisition Plat exhibit which, if approved, would begin the eminent domain proceeding. Following approval and issuance of the Relocation Order by the Common Council, the city would hire a consultant to prepare the appropriate appraisal to establish the value of the easement and proceed through the acquisition process. The land being acquired consists of 1,788 square feet, or about 0.041 acres, as identified in the attached Relocation Order and exhibits.
C. Fiscal Impact
There is no cost to the City for this acquisition, all consulting costs and acquisition costs will be paid for by the Developer through an existing agreement between the City and the Developer.
D. Recommendation
It is recommended that the Common Council approve the Relocation Order and Acquisition Plat in order that the acquisition of a twenty foot wide permanent water main easement can be acquired from 931-937 123rd Street.
