A. Issue
Approval of the Relocation Order and Acquisition Plat for the reconstruction of W. North Ave. from Met to Wee Ln. to Wauwatosa Ave. which includes two bridge replacements over the Menomonee River (CIP Projects #2301 & #1127).
B. Background/Options
The North Avenue bridge replacement and roadway reconstruction project from Met to Wee Ln. to Wauwatosa Ave is currently in design and planned to be constructed in 2028 & 2029. This project is partially funded by the Wisconsin Department of Transportation (WisDOT) through the Surface Transportation Program-Urban (STP-U).
In order to proceed with the reconstruction of North Avenue, the City identified 128 parcels impacted by the project. The acquisitions required include Right of Way Fee Acquisition from 30 parcels, Permanent Limited Easement (PLE) from 1 parcel, Temporary Limited Easement (TLE) from 119 parcels, and an estimated 9 Utility Release of Rights from adjacent properties as part of the typical WisDOT project process. All areas graded within the acquired land and easements will be restored in kind.
Attached is a proposed Relocation Order with an Acquisition Plat exhibit for the project. This includes a schedule of the interests required from each of the parcels.
The relocation order will allow the Early Acquisition for all parcels shown on the plat, except the following 17 parcels, which are not subject to early acquisition under this Relocation Order: Parcels: 2, 16, 24, 25, 32, 33, 34, 40, 43, 44, 45, 46, 51, 75, 76, 79, and 93.

D. Fiscal Impact
The cost of these acquisitions is included within the capital budget, although the final price will not be determined until such time as our acquisition consultant has concluded negotiations with the property owners.
E. Recommendation
It is recommended that the Common Council approve the Relocation Order and Acquisition Plat for the reconstruction of W. North Ave. from Met to Wee Ln. to Wauwatosa Ave. which includes two bridge replacements over the Menomonee River (CIP Projects #2301 & #1127) so that the project can be completed.
The recording of the Relocation Order and Acquisition Plat is pending WisDOT’s final approval of Early Acquisition.
