A.                     Issue

Acceptance of a permanent water main easement located at 931-937 North 123rd Street for purposes of necessary water main construction related to the extension of a water main from 123rd Street to 124th Street.

 

 

B.                     Background/Options 

In conjunction with the approved agreements to service a portion of Elm Grove with Wauwatosa water, hydraulic studies were completed to determine the necessary level of water infrastructure improvements. As part of that analysis it was determined that connection of two existing dead end water mains is necessary to provide appropriate water service to the new service area as well as benefiting the existing service area near 123rd Street and 124th Street south of Watertown Plank Road.   The new water main will be installed between the southern dead end of 123rd Street and the southern dead end of 124th Street. In order to accommodate this extension a 20 foot wide water main easement is needed from a portion of one property, 931-937 North 123rd Street.  The easement is located within an area currently used as a driveway and parking for the property owner's tenant's use.

 

The property owner requested a monetary purchase arrangement so the Common Council initiated the formal process to acquire an easement in July of 2023.  Through the current agreements between the City, Elm Grove, and the Developer, the cost for this acquisition will not be borne by the City of Wauwatosa.     

 

Following approval by the Common Council, city staff hired a consultant to prepare the appropriate appraisal to establish the value of the easement and proceed through the acquisition process. The property owner has now agreed to the terms of the purchase and has signed the attached easement.  Once accepted by the Board of Public Works and Common Council the property owner will be paid for the easement and the City will receive reimbursement from the Developer for the cost.

D.                     Fiscal Impact

There is no cost to the City for this acquisition, all consulting costs and acquisition costs will be paid for by the Developer through an existing agreement between the City and the Developer.

 

 

E.                     Recommendation

It is recommended that the Common Council accept the attached twenty-foot-wide permanent water main easement located at 931-937 123rd Street.
