A.                     Background/Options 

The applicant is requesting approval of a Conditional Use Permit to establish an outdoor seating area for an existing wine shop and wine bar located at 6710 W. North Avenue, within the Neighborhood/Village Trade and North Avenue Overlay (C1/NOR) zoning district. Surrounding land uses include residential to the north and commercial uses to the south, east, and west.

The proposed outdoor dining area will be located on the adjacent parcel to the east, which shares the same ownership as the wine bar property. The space will include a pergola, tables and chairs, and new landscaping features.

 

The applicant is also proposing to extend the previously approved business and outdoor dining hours. The new proposed hours are:

 

                     Monday and Tuesday: 4:00 p.m. - 9:00 p.m.

                     Wednesday through Saturday: 1:00 p.m. - 9:00 p.m.

                     Sunday: 1:00 p.m. - 6:00 p.m.

 

Attached to this report are the project description and associated plans for review.

 

The required public hearing before the Common Council occurred on April 22, 2025 with the applicant and the property owner speaking in favor of the proposal. Thirty-nine public notification letters related to the project were sent per City regulations. B.                     Staff Comments

Planning/Zoning Division

Bike parking shall be provided to accommodate additional usable area of the establishment.

 

Additional vehicle parking is not needed in that on street parking is available on North Avenue and 64th street, public transit is located within close proximity of the site, the project is located within close proximity to a residential neighborhood, and bike parking will be provided in accordance with City Code.

 

Building Division

A building permit, electrical permit, and any other applicable permits may be required depending on the scope of work. Additionally, the proposed project must be reviewed and approved by the Design Review Board prior to commencement of any construction or installation activities

 

City Assessor’s Office

Providing detailed costs of any alterations and/or new construction, as well as income & expense as requested by the Assessor's office.

 

City Clerk’s Office

Applicant will need to submit with the Clerk’s Office a request to amend the retail alcohol license premises description.

 

Engineering Division

Site plans are subject to approval by the Engineering Division.

 

Fire Department

All pertinent and applicable fire code must be adhered to. 

 

Health Department

C.                     Recommendation

Staff recommends approval subject to the following:

1.                     Establishing hours of operation.

2.                     Providing detailed costs of any alterations and/or new construction, as well as income & expense as requested by the Assessor's office.

3.                     The dining area kept clean, neat, and in an orderly appearance free of trash, debris, and/or obnoxious odors.  This includes upkeep of outdoor dining furniture.

4.                     Providing short- and long-term bicycle parking in compliance with City Code 24.11.080 prior to occupancy permit issuance.

5.                     Obtaining site plan approval from the Engineering Division.

6.                     Under WMC 24.16.040I., a Conditional Use will lapse and have no further effect one year after it is approved by the Common Council, unless a building permit has been issued (if required); the use or structure has been lawfully established; or unless a different lapse of approval period or point of expiration has been expressly established by the Common Council.

7.                     Obtaining other required licenses, permits, and approvals, including Design Review Board.
