Public hearing and consideration of the request by Dave Tamburinno, Idyll Coffee, for a Conditional Use Permit in the C1/NOR District at 6330 W. North Avenue for an eating and drinking establishment

A. Background/Options
The applicant is proposing to operate an 11,766 square foot eating & drinking establishment (coffee shop) with an accessory coffee roaster at 6330 W. North Avenue in the Neighborhood Village and North Avenue Overlay (C1/NOR) District. The floor plan contains two (2) floor levels: The first floor contains a sales counter, seating area, and a coffee roaster and the second floor contains an open seating area. An outdoor dining area is proposed at the south end of the building adjacent to North Avenue. In addition to the cafe and coffee roaster, the facility is also proposing to host perodic events such as indoor arts and craft fairs. The proposed operating hours are 6:00 am to 6:00 pm Monday through Sunday.
The project includes a coffee roaster at the eastern end of the building. To ensure the coffee roaster does not create any negative odor issues to surrounding properties, the coffee roaster will be equipped with an "after-burner" to neutralize odors before they can escape into the air. A description of the equipment can be found in the attached project description.

B. Staff Comments
Planning/Zoning Division: No additional parking is required as parking requirements in the C1 District are uniform for office, retail, and eating/drinking uses.
Building Division: Design Review Board approval required; plan review, applicable building permits. Final Occupancy inspection and approval required prior to occupancy.
City Clerk’s Office: No issues.
Assessor’s Office: Provide detailed costs of any alterations and/or new construction, as well as income & expense as requested by the Assessor's Office
Public Works Department: Site plans showing construction staging are subject to approval by the Engineering Division. For any building project in excess of $100,000, the sanitary sewer lateral is required to be replaced or repaired if the existing lateral does not pass Board of Public Works testing requirements according to City Code 13.30.030. Calculations based on fire flow needs is required. See City Code Section 14.20.080 for fire flow requirements. City Code requires that the required fire flow for sprinklered properties shall consist of the flow required for sprinklers and other on-site water consumption. The applicant will be required to schedule a hydrant flow test. This test will have to simulate winter operation conditions of the water system because the proposed fire sprinkler system must function under all conditions. Engineering must review and approve of any proposed hydrant testing in advance of scheduling any test. The applicant will be required to coordinate with the Fire Department and Engineering if a public fire hydrant will be required. Roof drains are required to be directly connected to the City's storm sewer through underground piping per City Code 15.04.060.F.2. To help improve the quality and safety of the bus stop, a concrete pad for a bus stop bench should be included in the redevelopment plans. The minimum dimension of the bus stop bench pad should be 3 feet deep by 8 feet wide and must not encroach within the 5 feet clear width for sidewalk users. Please work with Engineering as desired to discuss layout options. One handicap parking stall is provided. Per ADA requirements, this stall must be van accessible. Van accessible stalls must have an 8-foot-wide stall next to an 8-foot-wide access aisle. The van accessible aisle must be located on the passenger side. Van accessible signage must also be provided. Final plans must meet all requirements pertaining to landscaping and screening in zoning code Chapter 12.24.
Fire Department: All fire code must be followed at a minimum.
Health Department: Applicable food licenses required.
Police Department: No issues.
C. Recommendation
Staff recommends approval subject to:
1. Establishing hours of operation.
2. Providing detailed costs of any alterations and/or new construction, as well as income & expense as requested by the Assessor's office.
3. Site civil plans, landscape plans, and fire flow calculations addressing Engineering Division comments must be submitted to and reviewed by the Engineering Division prior to issuing building permits.
4. Under WMC 24.16.040I., a Conditional Use will lapse and have no further effect one year after it is approved by the Common Council, unless a building permit has been issued (if required); the use or structure has been lawfully established; or unless a different lapse of approval period or point of expiration has been expressly established by the Common Council.
5. Obtaining other required licenses, permits, and approvals.
