A. Background/Options
The applicant is proposing to operate a 2,007 square-foot eating establishment in a mixed-use building located at 7488 W. State Street in the Neighborhood/Village Commercial (C1)/Planned Unit Development (PUD) Zones. Surrounding land uses are primarily commercial with residential units above the tenant space.
The proposed eating establishment is “fast-casual” where food orders are taken at the counter and then picked up by the customer. The floor plan contains a dining area, kitchen, prep space, walk in cooler, and restrooms. The entrance into the space is located adjacent to the public sidewalk on Wauwatosa Ave. An outdoor eating area with 4 tables and 16 chairs is proposed at the front of the space adjacent to Wauwatosa Avenue, within the Right of Way. The applicant is required to obtain a sidewalk cafe permit for the outdoor seating. The proposed operating hours are 11:00 am to 8:00 pm Monday through Sunday.

B. Staff comments
Planning/Zoning Division: The tenant space was previously a restaurant.
No additional parking is required as parking requirements in the C1 District are uniform for retail and eating/drinking uses.
Outdoor dining is proposed within the ROW adjacent to Wauwatosa Ave. Applicant will need to obtain a sidewalk café permit.
Building Division: Plan review & applicable building permits including occupancy permit is required. DSPS plan approvals may be required depending on scope of work.
Assessor's Office: Provide detailed costs of any alterations and/or new construction, as well as income & expense information as requested by the Assessor's Office.
City Clerk’s Office: If they intend on selling or serving alcohol, they will need a license. If the outdoor seating is in the public sidewalk, they will need a sidewalk cafe permit. Otherwise, no issues.
Engineering Division: No issues.
Fire Department: No issues at this time. All fire codes will be followed.
Health Department: Applicable license required.
Police Department: No comments provided.
C. Recommendation
Staff recommends approvals subject to:
1. Establishing hours of operation.
2. Providing detailed costs of any alterations and/or new construction, as well as income & expense as requested by the Assessor's office.
3. Obtaining a sidewalk cafe permit from the City Clerk’s office for any outdoor dining in the right-of-way. The outdoor dining table and chair arrangement shall be modified to maintain a five foot wide clear path on the sidewalk.
4. Under WMC 24.16.040I., a Conditional Use will lapse and have no further effect one year after it is approved by the Common Council, unless a building permit has been issued (if required); the use or structure has been lawfully established; or unless a different lapse of approval period or point of expiration has been expressly established by the Common Council.
