A.                     Background/Options 

The applicant, Maria Souza, on behalf of Diamonds Direct, is requesting approval of a Conditional Use Permit to allow sales and acceptance of secondhand precious metals and gems at 2600 N. Mayfair Road in the General Commercial and Mayfair Overlay (C2/MAY) District.  The facility’s primary operation consists of the sale of new jewelry, precious metals, and gems.  Acceptance and sales of secondhand merchandise is a small portion (accessory) of the overall business operation.  The store is staffed with six employees, and operates Monday through Friday from 10:00 am to 7:00 pm, and Saturday from 10:00 am to 6:00 pm.  

 

B.                     Staff Comments

Planning/Zoning Division

A total of eight (8) public hearing notices were sent to nearby property owners. 

 

Building Division

No issues.

 

City Assessor’s Office

Provide detailed costs of any alterations and/or new construction, as well as income and expense as requested by the Assessor’s office.

 

City Clerk’s Office

Will need to apply for a Precious Metals and Gems License and a Secondhand Jewelry License.

 

Engineering Division

No comments.

 

Fire Department

All applicable fire code will be adhered to. 

 

Health Department

No comments.

 

Police Department

See attached Police Department Correspondence. 

 

C.                     Recommendation

Staff recommends approvals subject to:

1.                     Establishing hours of operation. 

2.                     Provide detailed costs of any alterations and/or new construction, as well as income & expense as requested by the Assessor's office.

3.                     Under WMC 24.16.040I., a Conditional Use will lapse and have no further effect one year after it is approved by the Common Council, unless a building permit has been issued (if required); the use or structure has been lawfully established; or unless a different lapse of approval period or point of expiration has been expressly established by the Common Council.

4.                     Obtaining other required licenses, permits, and approvals.
