Resolution approving the appeal of the denial of an Operator's License application for Nicole Bence and directing the City Clerk to issue the license

WHEREAS, the City Clerk denied the application of Nicole Bence for an Operator's License pursuant to Section 6.08.100 of the Wauwatosa Municipal Code and Wis. Stat. § 125.04 based on prior criminal convictions substantially related to the licensed activity; and
WHEREAS, pursuant to Wis. Stat. § 111.335(4)(c)1.b., an applicant may present competent evidence of rehabilitation, and if the governing body determines the applicant is rehabilitated, the license may not be denied on the basis of those convictions; and
WHEREAS, the Government Affairs Committee conducted a hearing, reviewed the applicant's evidence of rehabilitation, and determined that the applicant presented sufficient competent evidence of rehabilitation under Wis. Stat. § 111.335(4)(c)1.b.;
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Wauwatosa that the appeal of the denial of Nicole Bence's Operator's License application is granted.
BE IT FURTHER RESOLVED that the Common Council finds that the applicant has presented sufficient competent evidence of rehabilitation pursuant to Wis. Stat. § 111.335(4)(c)1.b.
BE IT FURTHER RESOLVED that the City Clerk is directed to issue an Operator's License to Nicole Bence, provided the applicant satisfies all other applicable statutory and municipal licensing requirements.
