Resolution approving entering an agreement with Landowners for recreational use of certain land located in the City of Wauwatosa and the City of Milwaukee, Wisconsin, CIP Project #2309, Wisconsin Avenue Multi-Use Path

WHEREAS, the City of Wauwatosa is undertaking the Wisconsin Avenue Multi-Use Path Project, CIP #2309, from Research Drive to Honey Creek Parkway; and
WHEREAS, a portion of the multi-use path will be located on certain land in the City of Wauwatosa and City of Milwaukee owned by MRMC Land Bank, LLC, Froedtert Memorial Lutheran Hospital, Inc., and Milwaukee Regional Medical Center Water Service, Inc.; and
WHEREAS, the proposed agreement grants the City a perpetual, non-exclusive easement and right-of-way over a portion of such property for construction, reconstruction, operation, maintenance, repair, replacement, and removal of a recreational trail;
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Wauwatosa that the proper City officials are hereby authorized to enter into an agreement with MRMC Land Bank, LLC, Froedtert Memorial Lutheran Hospital, Inc., and Milwaukee Regional Medical Center Water Service, Inc., or their applicable ownership interest, for recreational use of certain land located in the City of Wauwatosa and City of Milwaukee for the Wisconsin Avenue Multi-Use Path Project, CIP #2309.
