Resolution approving an encroachment agreement within the public right-of-way adjacent to the proposed Medical College of Wisconsin Student Housing Development at 8701 Watertown Plank Road

WHEREAS, an application has been made to the City of Wauwatosa by the Medical College of Wisconsin for an encroachment within the public right-of-way adjacent to the proposed Medical College of Wisconsin Student Housing Development at 8701 Watertown Plank Road for construction tie-back rods; and

 

WHEREAS, the proposed tie-back rods are to be installed under the south side of Watertown Plank Road and will remain below grade after construction; and

 

WHEREAS, the Board of Public Works recommended approval subject to review and conditions;

 

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Wauwatosa, Wisconsin that the requested encroachment within the public right-of-way adjacent to 8701 Watertown Plank Road is hereby approved subject to the following conditions:

1.                     Engineering Services Division review and approval of the construction tie-back rods, including Milwaukee Metropolitan Sewerage District review and approval as needed.

2.                     The applicant shall provide a to-scale plan and cross section of the tie-backs showing the starting depth, angle of downward depth, and the location of all existing public and private utilities.

3.                     As-builts of the construction tie-back rods shall be provided to the Engineering Services Division.

4.                     The applicant shall execute a hold harmless/encroachment agreement in favor of the City.
