A.                     Issue

Request to encroach in the City right-of-way with a mulched flower bed within the City right of way at 2044 Forest Street.

B.                     Background/Options

The flower bed is shown in the attached photos and drawing.  The flower bed is approximately four feet wide by eight feet long. The bed currently contains, and will contain in the future if approved, annual cut-garden flowers. While flowers are planted (approximately May through September), it will be surrounded by a short temporary fence to keep animals out, mulched, weeded, and all grass trimmed regularly. While empty (approximately October through April), the applicant has stated that they will remove the fence and keep the area in good repair.

There is underground street light electrical conduit that is direct buried within this area.

C.                     Strategic Plan (Area of Focus)

Priority Area Five:  Quality of Life

D.                     Fiscal Impact

No financial impact to the City.

E.                     Recommendation

Staff recommends approval of the encroachment request subject to execution of a Hold Harmless Agreement.
