Resolution approving quit claim deed, acceptance of constructed park amenities and adjacent land for park purposes, and an easement agreement with Vista Village Apartments at 7474 Harwood Avenue

WHEREAS, as a condition of site plan approval for the multifamily development at 7474 Harwood Avenue, the developer entered into a letter agreement in June 2025 regarding expansion of public park space; and
WHEREAS, the City has been presented with a Quit Claim Deed, a Dedication Deed and Acceptance of Park Amenities, and an Easement Agreement to effectuate the transfer of land, dedication of park improvements, and related easement rights for the expanded public park space; and
WHEREAS, the Easement Agreement provides for private encroachment, utility, and irrigation easements, a public lighting easement, and assigns ownership, maintenance, and repair responsibilities for certain retaining walls to the owner of 7474 Harwood Avenue;
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Wauwatosa, Wisconsin that the Quit Claim Deed, the Dedication Deed and Acceptance of Park Amenities, and the Easement Agreement with Vista Village Apartments at 7474 Harwood Avenue are hereby approved, and the proper City officials are authorized to finalize legal descriptions and exhibits, execute the documents, and record them prior to final building occupancy issuance.
