A. Issue
Request from J. Ross McIntyre for an encroachment to install a fence within existing City public utility easements at 7305 Wells Street
B. Background/Options
The applicant has provided much information related to the request. Existing sanitary sewer and water infrastructure is located within easements on the east and south side of the property. The location of these utilities in side and rear lot areas within this section of Wauwatosa is common. Vegetation, fences, and small structures have been built in these easement areas over the past many decades, some with approval, some without.
The application depicts a fence located in the front yard setback of the property. A fence in that location requires a fence permit per Municipal Code Section 15.28.030.
Multiple city departments will need to review the exact proposed locations of the fence. In general, trenchless technologies have provide ways to rehabilitate sanitary sewer and water main infrastructure without the need for full excavation and removal of surface impediments. Engineering and Public Works staff will review the pipe sections in this location and provide comments prior to any approval. Building and Safety staff will review and comment on the fence proposed in the front yard setback.
C. Fiscal Impact
No impact to the City of Wauwatosa. All costs for proposed work will be at the owner's expense.
D. Recommendation
City staff recommends approval of the request subject to the following conditions:
1. A Plat of Survey is submitted for the verification of fence locations within the public utility easements and to obtain a fence permit.
2. City of Wauwatosa Public Works and Water Department approvals of the fence locations.
