A. Issue
Request by WeEnergies for Nighttime Work Hours, 7:00 P.M. to 7:00 A.M., on Wauwatosa Avenue (S.T.H. 181) - Milwaukee Avenue to Warren Avenue
B. Background/Options
WeEnergies performed work for the Wauwatosa School District in the summer of 2023 to extend underground facilities between East High School and Lincoln Elementary School. The approved permit sketch is attached. The work included boring across Wauwatosa Avenue. The City requires contractors to locate existing underground utilities by coring a hole in the pavement when boring is the selected method of construction. The attached picture shows numerous cores holes in the pavement.
The permit required permanent restoration of the pavement upon completion. The work was not completed last summer before school started and needs to be completed this summer. The pavement restoration required of WeEnergies includes full removal of the asphalt and concrete road base and replacement, in kind, across the entire width of Wauwatosa Avenue. This requirement is based on the fact that the road was rebuilt in 2020. Completion of the work will require a full closure, or flagging operations, on Wauwatosa Avenue.
Staff has determined that since Wauwatosa Avenue is a connecting state highway and a main arterial, the work must be performed at night.
Municipal Code Section 15.02.100 states:
1. No person, firm or corporation shall at any time between the hours of seven p.m. and seven a.m. Monday through Saturday, or during any hours on Sunday create any loud or sharp noises, concussions, or disturbing sounds associated with the construction, excavation, demolition, alteration, or repair of any building or development.
