Resolution waiving the competitive bidding process and approving Contract Change Order #1 to Contract 25-18 with Scott Construction, Inc., for the 2026 Aggregate Sealcoating Program in the amount of $203,941.98

WHEREAS, a portion of the 2025 Aggregate Sealcoating Program was deferred due to flooding impacts in the affected neighborhood and the resulting presence of dumpsters, storage pods, construction traffic, and ongoing repair activity within the public right-of-way; and
WHEREAS, the deferred sealcoating work was postponed to 2026 because aggregate sealcoating is best completed by mid-September to ensure proper performance; and
WHEREAS, Scott Construction, Inc. has been the low and successful bidder for the City’s Aggregate Sealcoating Program for the past nine years and agreed to honor 2025 bid pricing for the deferred 2026 work; and
WHEREAS, staff has recommended waiving the competitive bidding process for the 2026 Aggregate Sealcoating Program and approving Contract Change Order #1 to Contract 25-18 with Scott Construction, Inc. in the amount of $203,941.98; and
WHEREAS, funding for the 2026 program area is included in the 2026 Operating Budget.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Wauwatosa that the competitive bidding process for the 2026 Aggregate Sealcoating Program is hereby waived and Contract Change Order #1 to Contract 25-18 with Scott Construction, Inc. is hereby approved in the amount of $203,941.98, and the proper City officials are authorized to execute the change order.
