A. Issue
Approve a Utility Occupancy License with Soo Line Railroad for installation, maintenance, and operation of an underground fiber optic conduit at N. 115th Street and the railroad tracks
B. Background/Options
The City continues to install fiber optic communication infrastructure between critical City facilities as part of the ongoing CIP Project 2402. This project consists of installing conduit and fiber optic cable from the Police Station south and east back to City Hall to create a full loop of fiber communications. Approval from CP to bore a conduit under the railroad tracks on 115th Street is needed. CP approved the construction plans and is agreeing to a Utility Occupancy License which will allow the City to install, maintain, and operate the utility line under its railroad property and tracks.

D. Fiscal Impact
Cost associated with the license include a one-time fee of $1.00 as well as reimbursement for CP’s charges for a flagman during the City’s work on their property. Adequate funds for CIP Project 2402 are included in the approved 2024-2028 Capital Budget.

Staff recommends the Common Council enter into a Utility Occupancy License with Soo Line Railroad for installation, maintenance, and operation of an underground fiber optic conduit at N. 115th Street and the railroad tracks
