Ordinance amending Sections 14.28.120 and 14.16.090 of the Wauwatosa Municipal Code related to false alarm fees and the fire prevention code

The Common Council of the City of Wauwatosa do hereby ordain as follows:
Part I. Subsection 14.28.120(A) of the Wauwatosa Municipal Code is hereby amended in its entirety to read as follows:
A. Any person, firm or corporation having a fire alarm, smoke detector or other type of alarm, and which alarm calls for a response from the fire department, shall be charged a fee for false alarms in accordance with the fees schedule adopted by the Common Council. If the possessor of the alarm can show to the satisfaction of the chief of the fire department that the false alarm was not the result of negligence or improper maintenance, such fee may be waived.
Part II. Section 14.16.090 of the Wauwatosa Municipal Code is hereby amended in its entirety to read as follows:
The fire chief of the Wauwatosa Fire Department or the chief fire inspector shall also recommend amendments to the fire prevention code or ordinance which, in his/her judgment, shall be desirable.
Part III. This ordinance shall take effect on and after its date of publication.
