WHEREAS, an application has been made to the Common Council of the City of Wauwatosa (hereinafter “City”) by Sarah Hillenbrand on behalf of the Mandel Group, 7470 Blanchard Street, Wauwatosa, WI, (hereinafter “the Applicant”) to encroach upon City property within the public right-of-way, for construction tie-back rods underneath Wauwatosa Avenue, for transformers, benches, bike racks and landscaping within the public right-of-way and for an interior exemption for the 42-stall public surface parking lot at 7470 Blanchard Street;  and

 

WHEREAS, the Common Council of the City of Wauwatosa has granted to said Applicant a privilege for the aforesaid encroachment subject to the execution of an Indenture to the City of Wauwatosa.

 

NOW, THEREFORE, BE IT RESOLVED THAT in consideration of the granting of said privilege by the Common Council of the City of Wauwatosa to said Applicant and the Applicant's acceptance of said privilege, the Applicant does hereby covenant unto the City of Wauwatosa as follows:

 

1.                     Engineering Services Division review and approval of the construction of the tie-back rods,

2.                     As-builts of the construction tie-back rods provided to the Engineering Services Division,

3.                     Public Works Department review and approve the proposed landscaping species within the Blanchard Avenue right-of-way,

4.                     Added language to the standard encroachment agreement requiring a deposit for maintenance of the proposed landscaping encroachment within the north side of the Blanchard Avenue right-of-way, approved by the City Attorney

5.                     Applicant shall execute a hold harmless/encroachment agreement (Indenture) in favor of the City.
