A. Background/Options
The applicant is requesting an additional one-year extension to the Planned Unit Development (PUD) Final Plan approval that was initially approved by the Common Council on January 18, 2022. Previous extensions were granted on December 20, 2022; January 16, 2024; and February 25, 2025, with the most recent approval establishing an expiration date of January 25, 2026.

The current extension request was submitted prior to the January 25 expiration date. However, due to application deadlines associated with Community Affairs Committee meeting schedules, the earliest the item could be brought before the Committee is the March 17 meeting.

With the recent zoning code changes, pursuant to Section 24.16.050.D.5.A, if a landowner fails to commence the development shown on the Final Development Plan within two years after final approval has been granted, the approval will lapse and be of no further effect unless the time period is extended by the Common Council upon written application by the landowner. Previously, final approval lapsed after 12 months. However, even with this recent change, an extension is still required because the Final PUD approval was originally granted in 2022.
