Resolution approving settlement of Phoenix Wauwatosa II Industrial Investors, LLC v. City of Wauwatosa, Milwaukee County Case No. 2026-CV-2685

WHEREAS, Phoenix Wauwatosa II Industrial Investors, LLC filed litigation against the City of Wauwatosa and the City’s Board of Review in Milwaukee County Circuit Court, Case No. 2026-CV-2685, challenging the 2025 assessment of property located at 3300 N. 124th Street, Tax Parcel No. 258-0003-004; and
WHEREAS, the parties have reached a proposed settlement providing for a revised 2025 assessment and a property tax refund; and
WHEREAS, under the proposed settlement, each party will waive any claim to interest or costs and will bear its own attorneys’ fees and expert fees; and
WHEREAS, upon payment of the refund, the parties will file a stipulation dismissing the case with prejudice.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Wauwatosa that the proposed settlement agreement in Phoenix Wauwatosa II Industrial Investors, LLC v. City of Wauwatosa, Milwaukee County Case No. 2026-CV-2685, is hereby approved, and the City Attorney’s Office is authorized to finalize and execute the agreement, including minor non-substantive changes consistent with the terms presented.

The Common Council may convene in closed session regarding this item pursuant to Wis. Stat. §19.85 (1)(g), to confer with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved. The Common Council may reconvene into open session to consider any action discussed in closed session and/or the balance of the agenda.
