A. Issue
Request by Terry Castonguay for a parking pad encroachment on a City owned parcel adjacent to 10227 Fischer Parkway.
B. Background/Options
The applicant lives next to a City-owner parcel that has a storm sewer running through the parcel and discharges storm water from the neighborhood into the Underwood Creek. The parcel is also located within the floodplain of the Underwood Creek. No structures and/or changes to the elevations on the parcel are permitted. The City mows the area twice per year, similar to other natural area around the City. The applicant has taken it upon himself to keep the grass mown at a more residential level over the past few years.
The applicant is requesting permission to pave a portion of the grass with concrete and use as a parking pad. The attached picture shows the current site conditions and can be used to visualize where a parking pad is proposed. The shed shown in the picture will need to be relocated if it is determined to currently be located on the City parcel.
City Engineering and Public Works staff have reviewed the request and have no reservations.

E. Recommendation
Staff recommends approval of the encroachment agreement subject to execution of a Hold Harmless agreement and proof of insurance naming the City as an additionally insured, to be renewed annually.
