A. Issue
The Engineering Services Division is requesting acceptance of a Non-Motorized Multi-Use Pedestrian Trail Easement Agreement at 3029 N. 112th Street.


B. Background/Options
The property at 3029 N. 112th Street is proposed for redevelopment into a car wash. As part of the site plan approval process, staff required that space for a multi-use trail must be accommodated into the proposed site plan. As properties redevelop along the west side of N. 112th Street, space must be reserved for a five feet wide terrace, ten feet wide multi-use trail and two feet wide clear space behind the existing N. 112th Street curb for future City multi-use trail construction. This future multi-use trail is intended to connect Mayfair Collection to the public schools to the south. To accommodate this full cross section, a nine-foot-wide easement parallel to the existing public right-of-way is proposed. The approved site plans for this redevelopment show the area that is reserved for multi-use trail, the proposed acceptable cross slope within the easement, and no permanent obstructions.

The proposed agreement is attached. The City will be responsible for construction of the trail when funds are available. After the trail is constructed, snow removal shall be the responsibility of the property owner in accordance with City Code 24.12.010. The property owner's financial obligations towards the repair or maintenance of the trail after construction will be in accordance with the City's assessment resolution at the time of such repair or maintenance is required.
