A. Issue
Jordan Cole of North 48 Bar LLC, d/b/a North 48 Bar, 7603 W. State Street, has submitted an application for a new sidewalk café license.
Section 6.38.090 of the Wauwatosa Municipal Code requires applications for new sidewalk café licenses to be reviewed and approved by the Board of Public Works. Additionally, Section 6.38.160 of the code requires Council approval if the application includes the use of on-street parking spaces.
The applicant is requesting a sidewalk café license to provide outdoor seating at the North 48 Bar, located at 7603 W. State Street. Application materials, including a detailed plan drawing, written plan of operations (includes hours of operation and capacity information), and certificate of insurance, are included with this file.
B. Departmental Review
The application was routed to several City departments for review. Comments are listed below.
Police: No issues.
Engineering: Detail for the proposed pedestrian barriers must be provided and subject to approval by City Engineering. The proposed seating is taking up parking spaces in the street. Per City Code 6.38.160, the use of on-street spaces must be approved by the Common Council.
Planning: No issues.
City Attorney: No issues.
C. Recommendation
I recommend the Board of Public Works recommend approval of the application by Jordan Cole, North 48 Bar LLC, d/b/a North 48 Bar, 7603 W. State Street, for a sidewalk café license.
